1 - YOUR ACCOUNT

You are also responsible for all activity conducted through your account, unless such activity or purchases are carried out by an unauthorised third party who has gained access fraudulently or in circumstances not attributable to negligence on your part. It is your responsibility to scan any material downloaded from this website using antivirus or other security software and to check that it is compatible with your device.
If you provide us with information relating to a third party, you warrant that you have obtained that party’s consent to disclose their sensitive data and that they have been properly informed of, understood and accepted our Privacy Policy and Cookie Policy. 2 - OUR SALES POLICY
These Terms and Conditions of Sale govern exclusively the offering of Products and the submission and acceptance of purchase orders on www.nortbeachwear.com between users of the website and NORT S.r.l., whose registered office is at Piazzale di Ponte Milvio, 14, Rome, Italy, Tax Code and VAT No. 15431241007.
NORT S.r.l. (the “Seller”) sells Products through www.nortbeachwear.com. Its e-commerce services are available exclusively to end customers who qualify as private consumers, meaning individuals acting for personal purposes unrelated to their trade or profession. If you are not a private consumer, please do not purchase Products through the website and contact our offices instead.
NORT S.r.l. therefore reserves the right not to process orders placed by users who are not private consumers, or any other order that does not comply with its sales policy.
These Terms and Conditions of Sale do not apply to products or services supplied by third parties whose websites are linked to ours through banners or other hyperlinks. Before placing orders or purchasing products or services from such third parties, please review their terms and conditions. NORT S.r.l. cannot be held responsible for the supply of third-party products or services, or for transactions between users of www.nortbeachwear.com and any third parties linked to or otherwise featured on our website.
3 - PLACING AND ACCEPTING ORDERS
To purchase Products from our website, you must:
- Read and accept these Terms and Conditions of Sale.
- Provide all information requested in the order form, including your name, address, telephone number, email address, delivery address if different from your billing address, payment details and any other information required to complete your order.
- Have the legal capacity to enter into binding contracts.
- Be the holder or an authorised user of a valid credit or debit card.
You can shop online at www.nortbeachwear.com 24 hours a day, seven days a week. To place an order, click the ADD TO CART button and follow the instructions at checkout. Before confirming your order, you will have the opportunity to review it, read and accept these Terms and Conditions of Sale and our Returns and Refunds Policy, check the total amount, verify the information you have provided and correct any errors.
Please note that NORT S.r.l. does not currently ship to all countries. We apologise if we are unable to accept an order because of its delivery address.
4 - ORDER PROCESSING, CONTRACT INFORMATION AND PERFORMANCE
After submitting and confirming an order through www.nortbeachwear.com, you will receive an email from NORT S.r.l. at the address provided when placing your order. This email will acknowledge receipt of your order and include details of the Products ordered (the “Order Confirmation”).
The sales contract will become binding only when you receive a shipping confirmation email, which NORT S.r.l. will send after checking the availability of the selected Products (the “Shipping Confirmation”). The contract will cover only the Products listed in that Shipping Confirmation. NORT S.r.l. will not be obliged to supply any other unavailable Products included in your order until their shipment has been confirmed in a separate Shipping Confirmation.
Orders may be amended or cancelled before the delivery process has begun by calling 800 766 459, Monday to Friday, from 9:00 a.m. to 6:00 p.m., or by emailing info@nortbeachwear.com. Once the delivery process has begun, orders can no longer be amended or cancelled. However, you may refuse delivery, in which case the Products will be returned to NORT S.r.l., or accept delivery and subsequently return the Products in accordance with our Returns and Refunds Policy.
NORT S.r.l. may decline any order at its sole discretion, including, for example, where there is a pricing error, where an order appears unusual or where NORT S.r.l. believes it has been placed in bad faith.
5 - PRICES, SHIPPING AND DELIVERY CHARGES
The price charged for a Product will be the price applicable when the order is placed, as stated in the Order Confirmation and Shipping Confirmation. If a pricing error appears on NORT S.r.l.’s website, in an order acknowledgement or elsewhere, you agree that NORT S.r.l. may correct the error and charge the correct price or cancel the order. If the actual price of your selected Product is higher than the amount stated in the order acknowledgement, NORT S.r.l. will promptly notify you and give you the opportunity to cancel your order.
Product prices include VAT and/or any other applicable taxes, as well as shipping and handling charges. NORT S.r.l. may change Product prices and shipping charges at any time. Such changes will not affect orders for which a Shipping Confirmation has already been sent, except in the event of an obvious pricing error as described above.
6 - PAYMENTS
Payment for an order, including all applicable taxes, must be made using one of the methods specified in the order form. To complete your order, you must provide all requested information. As the purchaser, you warrant that this information is accurate and truthful and that you are authorised to provide and use the payment details supplied.
All information and sensitive data required to complete the sale, such as your card number and expiry date, will be transmitted using an encrypted protocol to banks and other authorised financial service providers offering remote electronic payment services, without access by other third parties. The Seller will use this information in full compliance with the General Data Protection Regulation (GDPR), solely in connection with the contractual relationship governing the sale of the Product and your consumer rights relating to returns and refunds, without prejudice to other legal rights and obligations. NORT S.r.l. accepts and processes major credit and debit cards through PayPal. If the required authorisation is not received from your card issuer or payment service provider, NORT S.r.l. reserves the right to decline the order.
7 - TAX INFORMATION
Purchases through NORT S.r.l.’s website, www.nortbeachwear.com, are reserved for private consumers. Our prices therefore always include VAT and any other applicable taxes. NORT S.r.l. issues an invoice for every order, which will be attached to the Shipping Confirmation email. Once an order has been confirmed, the billing details cannot be amended and a replacement invoice cannot be issued.
8 - PAYMENT SECURITY
Purchases made through www.nortbeachwear.com are processed securely using the PayPal payment platform. PayPal provides its services in compliance with the Payment Card Industry Data Security Standard (PCI DSS), an international standard establishing mandatory security requirements for businesses that handle, process or store credit or debit card data and/or other payment information, regardless of their size or geographical location. The payment platform also complies with 3D Secure 2 (3DS2), the new industry standard for customer authentication designed to meet the Strong Customer Authentication (SCA) requirements of PSD2. To help protect your credit card purchases, you will be asked to enter your CVV code for each order. As an additional security measure, your card issuer may also ask you to authorise the payment using a one-time password, an SMS code or another authentication method.

NORT S.r.l. makes every reasonable effort to ensure that the images shown on the website accurately represent the Products supplied. However, slight differences may occur between the Product displayed and the item delivered, particularly in colour, as the colours you see depend on the system and device used to browse the website. Regardless of these reasonable and unavoidable differences, please contact NORT S.r.l.’s Customer Service by email or telephone if the Products received do not match those ordered, your delivery is incomplete or a Product has been damaged in transit.
NORT S.r.l.’s website may contain typographical errors, inaccuracies or omissions relating to Product descriptions, prices or availability. NORT S.r.l. therefore reserves the right to correct such errors, inaccuracies or omissions and to amend or update information at any time without prior notice, including after an Order Confirmation has been sent. If information on NORT S.r.l.’s website differs from information on another website or from any other source, the information concerning Product suitability displayed on NORT S.r.l.’s website at the time of purchase will be considered the sole authoritative information for the purposes of the sales contract.
11 - PROMOTIONS
From time to time, NORT S.r.l. may offer prize draws, competitions or other promotions that require you to submit materials or personal information. These promotions may be subject to separate rules setting out their terms, any restrictions or eligibility requirements, and specific conditions governing the use of materials submitted to NORT S.r.l. and the personal information required to participate.

12 - OWNERSHIP OF PRODUCTS
Ownership of the Products will pass to you once payment for your order has been completed. However, responsibility for the Products will pass to you only when you, or a person acting on your behalf, take physical possession of them.
13 - DELIVERY
Products purchased through www.nortbeachwear.com are normally delivered by standard delivery within 2 business days of the order date in Italy and within 8 business days for all other destinations, provided payment is received by 2:00 p.m. on the day the order is placed.
We are currently unable to deliver to PO boxes.
Deliveries may be slightly delayed during holiday periods, as some couriers do not deliver on 25 December, 26 December, 1 January, other public holidays or weekends. However, in accordance with applicable law, Products must be delivered within 30 days of the Shipping Confirmation.
If, for any reason, NORT S.r.l. is unable to deliver your order within the period specified in the Shipping Confirmation, we will notify you as soon as possible. You may then choose to cancel your order, in which case NORT S.r.l. will refund the order amount.
If there are delays in receiving or accepting delivery, particularly after NORT S.r.l. has notified you that the courier has already attempted delivery, or if an incorrect delivery address results in a failed delivery, the Product will be returned to NORT S.r.l., your order will be cancelled and you will receive a full refund.
All deliveries must be signed for by an adult. You agree that any person accepting delivery at the designated address will be deemed duly authorised to do so on your behalf.
14 - RETURNS AND REFUNDS

NORT S.r.l. will accept items for a full refund provided they are returned in their original condition, together with all original packaging and protective covers. NORT S.r.l. will not accept returns of items that have been worn, used, altered or damaged, and reserves the right, at its sole discretion, to refuse any return that does not meet these requirements.
Once your return has been received, NORT S.r.l. reserves up to 7 business days to inspect the condition of the item. If the item meets our return requirements, your refund will be issued within 14 business days of the date on which this is confirmed.
In accordance with applicable law, items must be returned within 14 days of receipt for orders delivered in Italy, or within 19 days for orders delivered elsewhere in Europe and 22 days for orders delivered outside Europe, calculated from the date of the Shipping Confirmation. We recommend using an insured postal service or an international courier that provides shipment tracking, as NORT S.r.l. accepts no liability for refunds or compensation if return parcels are lost, stolen or mishandled.
Refunds will be issued to the original payment method.
Shipping costs for all returns and size exchanges are the customer’s responsibility, in accordance with Article 57(1) of Italian Legislative Decree No. 206/2005 (the Italian Consumer Code).
For returns, NORT S.r.l. will deduct a shipping charge of €10.00 (ten euros) from the refund due to the customer.
For size exchanges, the customer must pay a shipping charge of €10.00 (ten euros).
All cancellations and/or returns will be handled in accordance with Italian and European consumer protection laws, specifically Italian Legislative Decree No. 21 of 21 February 2014, which implements Directive 2011/83/EU on consumer rights and amends the Italian Consumer Code established by Legislative Decree No. 206 of 6 September 2005.
15 - WARRANTY
THE WARRANTY ON NORT-BRANDED PRODUCTS GIVES YOU SPECIFIC RIGHTS, WHICH MAY VARY FROM COUNTRY TO COUNTRY DEPENDING ON LOCAL LAWS AND REGULATIONS.
Products sold through NORT S.r.l.’s website come with a warranty covering Product quality and workmanship, providing protection against defects for the periods specified below for each type of Product.
The warranty entitles you to request a free replacement if a Product is defective and/or does not conform to the contract. Refunds, where authorised, will generally be issued using the same payment method used for the original purchase.
This warranty is provided to the original purchaser of the Product through NORT S.r.l.’s website, www.nortbeachwear.com, and is non-transferable. Please retain your Order Confirmation or invoice, or pass it on to the recipient if the Product is a gift, as proof of purchase and warranty entitlement. If the original receipt or invoice is unavailable, a credit card statement or bank statement showing the relevant transaction will be sufficient.
THE WARRANTY DOES NOT COVER NORMAL WEAR AND TEAR OR DAMAGE CAUSED BY ACCIDENTS, EXERCISE OR IMPROPER USE.

16 - EVENTS BEYOND THE SELLER’S CONTROL
NORT S.r.l. will not be liable for any delay or failure to perform its obligations under this contract to the extent that, and for as long as, performance is prevented by an event of force majeure.
For the purposes of this section, “force majeure” includes, but is not limited to:
- Civil unrest, riots, invasion, terrorist attacks or threats of terrorist attacks, war, whether declared or not, or the threat of or preparation for war.
- Strikes, lockouts or other industrial action.
- National or local states of emergency.
- Disruption or failure of communication or transport infrastructure.
- Power outages or interruptions to services.
- Failure by suppliers or subcontractors to fulfil their obligations, excluding companies affiliated with NORT S.r.l.
- Earthquakes, fires, explosions, storms, floods, subsidence, epidemics or other natural disasters.
- Inability to use railways, shipping, aircraft, motor transport or other means of public or private transport.
- Acts, decrees, legislation, regulations or restrictions imposed by any government.
The period allowed for NORT S.r.l. to perform its obligations will be extended by the duration of the force majeure event.
17 - LIABILITY
NORT S.r.l. warrants that all Products purchased through www.nortbeachwear.com are well made using quality materials and are reasonably fit for the purposes for which products of that kind are commonly supplied. These Terms and Conditions of Sale set out the full extent of NORT S.r.l.’s obligations and liability in relation to NORT-branded Products sold through its website. To the extent permitted by applicable law, no warranties, conditions or other terms will be binding on NORT S.r.l. beyond those set out in these Terms and Conditions of Sale.
NOTHING IN THESE TERMS AND CONDITIONS OF SALE AFFECTS ANY STATUTORY CONSUMER RIGHTS UNDER APPLICABLE LAWS AND REGULATIONS.
18 - OBLIGATIONS
These Terms and Conditions of Sale constitute the entire legal agreement between NORT S.r.l. and you as the purchaser, and supersede all previous contracts, understandings or other agreements between the parties, whether oral or written.
If any provision of these Terms and Conditions of Sale is found to be unlawful, invalid, void or otherwise unenforceable in any country or by any local court, that provision will be deemed severable from these Terms and Conditions of Sale and will remain enforceable to the fullest extent permitted by law. This will not affect the validity or enforceability of the remaining provisions or of the contract as a whole.
19 - TRANSFER OF RIGHTS AND OBLIGATIONS
These Terms and Conditions of Sale are binding on you as the purchaser, on NORT S.r.l. as the Seller and on any other legal entity to which NORT S.r.l. may transfer its rights. You may not, for any reason, assign or transfer to another party any of your rights or obligations under these Terms and Conditions of Sale, in whole or in part. NORT S.r.l., however, may assign or otherwise transfer its rights and obligations to third parties in accordance with applicable law.
20 - WAIVER
These Terms and Conditions of Sale, together with the Privacy Policy, Cookie Policy and Terms and Conditions of Use, constitute the entire agreement between you as a user and/or purchaser and NORT S.r.l. in relation to their subject matter. They supersede all previous promises, representations, agreements, contracts and understandings between the parties. Any failure by NORT S.r.l. to exercise or enforce a right or provision under these Terms and Conditions of Sale will not constitute a waiver of that right or provision.
21 - EXCLUSIVE JURISDICTION AND GOVERNING LAW
These Terms and Conditions of Sale and purchases of Products through www.nortbeachwear.com will be governed by and interpreted in accordance with Italian law, without regard to conflict-of-laws rules. Any dispute or claim arising out of or in connection with these Terms and Conditions of Sale or the purchase of Products from NORT S.r.l., including non-contractual disputes or claims, will be subject to the exclusive jurisdiction of the Italian courts. The Court of Rome will have sole and exclusive jurisdiction, which may not be derogated from.
